Firm Celebrates 75th Anniversary

On July 4, a cocktail reception was held at the Las Caobas Hotel in San Francisco de Macorís to celebrate the 75th anniversary of our firm. In attendance were many justices and judges of the Supreme Court and the lower courts, lawyers from many parts of the country and clients of the firm. In his keynote speech, Fabio J. Guzmán, managing partner of the firm, announced the expansion of the Santo Domingo office of the firm and the possibility of opening a new office in La Romana.

New Code of Criminal Procedure

After two years of deliberations, the Senate approved on July 2 a new Code of Criminal Procedure. The new Code constitutes a sea change with respect to the old Code which essentially dated from 1810. Of special interest are new provisions extending the rights of the accused.

New Law vs. Money Laundering

New Law vs. Money LaunderingThe Dominican Chamber of Deputies recently approved new legislation against the laundering of funds obtained through the traffic in illicit drugs. According to the new law, convicted money launderers will be punished with imprisonment from 3 to 10 years and fines of 50 to 100 times the minimum salary. There will be no bail for the accused during trial. Financial institutions will be subject to more strict reporting to the authorities of suspicious deposits.

Anti-Dumping Law Passed

President Mejía signed into law the first Dominican Anti-Dumping legislation to protect local producers from imports at prices considered below the ones charged in their countries of origin. Local manufacturers affected by the dumping of imports will now have the right to request the President to adopt protective measures and temporary safeguards to prevent or compensate the effects of the dumping. Enforcement of the law will be the responsibility of a commission ("Comisión Reguladora de Prácticas Desleales de Comercio y Medidas de Salvaguarda") which will investigate, prosecute and sanction dumping activities..
